These Terms of Service govern the use of the Buzzr mobile application (the "Application") developed by Adz Meta Solution Private Limited (the "Service Provider"). By downloading or using the Application, you agree to abide by these terms. Please read them carefully.

Usage Guidelines

By accessing or using the Application, you automatically agree to these terms. Unauthorized reproduction, modification, or distribution of the Application or any of its components—including its trademarks—is strictly prohibited.

You are not permitted to:

  • Extract the source code
  • Translate the Application
  • Create derivative versions
  • Bypass system restrictions or licensing mechanisms

All intellectual property rights, including copyrights, trademarks, and database rights, are owned by the Service Provider.

Application Modifications & Charges

The Service Provider aims to maintain a reliable and efficient Application. They may:

  • Modify the Application
  • Introduce new features
  • Implement or revise charges for features or services

Any changes in fees will be communicated clearly in advance.

Data and Security

The Application processes the personal data you provide to deliver its services. It is your responsibility to:

  • Secure your device and Application access
  • Avoid jailbreaking or rooting your device, which can compromise security and may affect functionality

Third-Party Services

The Application incorporates services from third parties, each governed by their own terms:

  • Google Play Services
  • Google Analytics for Firebase
  • Firebase Crashlytics
  • Facebook
  • Sentry

The Service Provider is not responsible for issues arising from these external services.

Connectivity and Charges

Some functionalities require an active internet connection (Wi-Fi or mobile data). The Service Provider is not liable if limited connectivity affects performance. Users are responsible for any data charges, including roaming, incurred while using the Application.

If you are not the account holder of your device, it is assumed you have the necessary permissions to use the Application.

Device and Service Limitations

  • You are responsible for ensuring your device remains charged and functional.
  • The Service Provider is not liable for service interruption due to device failure.

Accuracy and Updates

While the Service Provider strives for accuracy and timeliness, some information is provided by third parties. As a result, they are not liable for any loss resulting from reliance on such information.

Application updates may be necessary to maintain functionality. You agree to install updates when prompted. The Service Provider may also discontinue the Application without prior notice.

Upon termination:

  • Your right to use the Application ends
  • You must delete the Application from your device

General Terms

1. Platform Role

Buzzr acts solely as a facilitator between Brands and Influencers. It does not guarantee outcomes or take responsibility for disputes between parties.

2. Non-Refundable Payments

All payments made on the platform (subscriptions, campaigns, etc.) are non-refundable.

3. Payment Security & Approval Flow

  • Brands pay Buzzr upfront.
  • Influencers submit a Request Submission after completing their deliverables.
  • Once the Brand approves, Buzzr releases the funds to the Influencer’s wallet.
  • If deliverables are incomplete, the Brand can dispute. A valid claim results in a refund.
  • Applicable GST and gateway charges are applied.

4. Wallet System

  • Brands: Can add funds but not withdraw.
  • Influencers: Can withdraw funds but not add.
  • Wallet balances can only be used within the platform.

5. Legal Compliance

Users must comply with all applicable laws, including:

  • Data privacy regulations
  • Tax laws
  • Advertising standards

Terms for Influencers

1. Subscription & Access

  • Influencers must pay a monthly subscription to access paid campaigns.
  • Failure to pay may lead to account suspension.
  • GST (18%) applies to subscription fees.

2. Campaign Deliverables

  • Deliverables must meet Brand guidelines.
  • Content must be genuine, compliant with ASCI (Advertising Standards Council of India) standards.
  • Failure to complete deliverables may result in non-payment.

3. Payouts & Taxes

  • Payments are made to the Influencer's Buzzr Wallet.
  • Withdrawals are processed to a linked bank account.
  • TDS (1%) is deducted under Section 194C of the Income Tax Act.
  • Influencers must provide a valid PAN and bank details.

4. Prohibited Activities

  • Fake engagement (bots, fake followers)
  • Violations of campaign guidelines
  • Fraudulent activity may result in permanent account suspension

Liability Disclaimer

  • Buzzr is not responsible for disputes between users.
  • No guarantee is made regarding campaign performance or user engagement.
  • Buzzr is not liable for third-party data breaches, tax matters, or misuse of content.

Data Sharing & Privacy

  • User data is collected strictly for platform operations.
  • Anonymized data may be shared with services such as Google, Meta, and Firebase.
  • Buzzr is not liable for unauthorized access of your data by third parties.

Governing Law & Dispute Resolution

  • These terms are governed by Indian law.
  • Disputes will be resolved via arbitration in Udaipur, Rajasthan.

Termination

  • Buzzr may terminate user accounts that violate these terms at any time.
  • Users can choose to terminate their account, but no refunds will be issued.

Changes to These Terms

These Terms of Service may be updated periodically. Continued use of the Application constitutes acceptance of any changes. Updates will be posted on this page.
